  1. Introduction

Thank you for your support of the voice actor Yuki Kaji’s 20th anniversary project, Soyogi Fractal, and Bon Soyogi.

In order for everyone to further enjoy creating derivative works based on the character illustrations, voice synthesis software, and other products, services, and content we provide in this project, we hereby publish the following guidelines.

These guidelines are provided as a supplement to the terms of use and other agreements governing our products and services, and are intended to clarify and provide interpretive guidance specifically regarding derivative works.

We kindly ask that you comply not only with the terms of use for each product or service, but also with these guidelines.

  2. 01Basic Principles

We hope that this project, as well as our products, services, and content, will be widely enjoyed, and that many people will have fun creating derivative works.
Accordingly, we generally allow free creation of derivative works for purposes such as personal enjoyment, fan activities, circle activities, support, and promotion.

However, as technology and society evolve, new forms of enjoyment have emerged, and misuse has also become easier.

Therefore, in order to clarify what kinds of derivative works are permitted and what kinds are prohibited, and to protect this project and our products, services, and related content, we provide the following explanations, clarifications, and prohibitions.

  3. 02Derivative Works Activities

    1. Scope of Applicable Products, Services, and Content

The products, services, and content covered by these guidelines include all character illustrations (including full-body images, half-body images, icons, and silhouettes), voice synthesis software (including voices within the software), and all other products, services, and content such as images and videos that we publish or sell via our websites (official website, YouTube, Twitter, etc.) (collectively, the “Covered Content”).

Photographs, images, videos, and audio of Yuki Kaji that are not included in the Covered Content are outside the scope of these guidelines. Please do not use such materials for derivative works without our prior consent. If you wish to use them, please contact us in advance using the contact information provided at the end of this document.

    2. Methods and Forms of Derivative Works

When creating derivative works based on the Covered Content, please comply with any applicable terms of use and do not use character illustrations, logos, images, or videos as-is. Please add your own originality when creating derivative works. Derivative works that are essentially unchanged from the original (such as simple tracing) are not permitted.

Derivative works you create may be used within the scope of personal enjoyment, fan activities, circle activities, support, and promotion, as well as for sale, exhibition, wearing, or photography at events such as video productions, doujin conventions (e.g., Comiket), and cosplay events.

Additionally, you may use the Covered Content as-is when introducing it or comparing it with other products, services, or content, provided that it is clearly distinguishable from your own content or derivative works.
In such cases, please include the credit “Soyogi Fractal” and “© Yuki Kaji”.

  4. 03Prohibited Derivative Works

    1. Principle: Prohibition of Commercial Use

Commercial use, including the sale of goods beyond the scope of doujin conventions such as Comiket or use beyond personal or hobby activities, is prohibited.

While it is difficult to define a clear boundary, for example, if a company produces and sells goods based on derivative works of the Covered Content as part of its business, this will be considered commercial use.

If you wish to engage in any of the prohibited activities described in this section, you must enter into a license agreement or similar arrangement with us. Please contact us in advance.

    2. Exceptions: Permitted Uses

As exceptions to the above, the following uses are permitted:

      1. Use within the scope of personal enjoyment, fan activities, circle activities, support, and promotion
      2. Use for sale, exhibition, wearing, or photography at events such as video productions, doujin conventions (e.g., Comiket), and cosplay events
      3. Use of derivative works in videos on platforms such as YouTube
In this case, monetization through platform-based revenue (e.g., ad revenue) is permitted
However, monetization through Super Chats, donations, or similar features is not permitted
      4. TuneCore Distribution of derivative music works via TuneCore Japan
In this case, receiving revenue from such distribution is permitted
    3. Other Prohibited Acts

In addition to the above, the following are prohibited:

      • Representing derivative works as official products, works, or services, or creating the appearance of official endorsement, collaboration, or partnership
      • Use in services that allow individual payments or subscriptions, such as tipping, Super Chats, gifts, or memberships
      • Use that damages or may damage the reputation, honor, dignity, brand value, image, rights, or interests of the Covered Content, this project, Yuki Kaji, related parties, or third parties
      • Use that supports, promotes, pressures, or interferes with specific ideologies, religions, political views, or scientific opinions
      • Use that violates public order and morals, involves antisocial activities, or violates laws and regulations
      • Impersonation, creation of fake accounts, dissemination of false news, false reports, misinformation, or rumors
      • Analysis, decompilation, disassembly, reverse engineering, or similar actions regarding the Covered Content
    4. Supplementary Notes

Among the Covered Content, voice synthesis software allows for the creation of spoken dialogue and singing. While this is an intended use, many scripts, texts, lyrics, and musical works are protected by third-party copyrights.

Using such materials may require permission from the respective rights holders.

If required permissions are not obtained (except where permitted by law), such use may constitute copyright infringement. Please obtain any necessary permissions on your own responsibility.

We recognize that determining what constitutes a copyrighted work can sometimes be difficult. If you are unsure, we recommend consulting a professional to avoid unintended infringement.

  5. 04Requests for Correction

Due to the nature of terms of use and guidelines, it is not always possible to clearly define every case.
As stated above, we wish for everyone to enjoy creating derivative works.
However, if we determine that a derivative work violates these guidelines or the terms of use, we may request corrective action.

If such requests are not followed, we may require suspension or cessation of use of the Covered Content, deletion of derivative works, or suspension, termination, or prohibition of related activities.
    We appreciate your understanding.

  6. 05Revisions to the Guidelines

We may revise these guidelines from time to time in response to changes in social conditions and environments, with the aim of making them clearer and ensuring that everyone can safely and confidently enjoy creating derivative works.
Please check the latest version when engaging in derivative activities.
